Pocko terms of use
The short version: Pocko is a friendly AI that can be wrong, you stay in charge of your PC, use him kindly and lawfully, and the early access is free and comes "as is".
These terms are an agreement between you and [PLACEHOLDER: legal name of the person or company running Pocko], [PLACEHOLDER: country] ("we", "us"), for using Pocko, the desktop buddy for Windows, its control center, Pocko Cloud, and this website including the waitlist. By installing or using Pocko you agree to them. Our privacy notice explains how your data is handled.
1. Early access
- Pocko is an early, invite-only beta. It's free, it will have bugs, and features may change, break or disappear. Joining the waitlist doesn't promise you an invitation or a date.
- Invites are personal. Don't share your sign-in, the installer or download links.
- You must be 18 or older.
- We may end the beta, or your access, at any time; we'll try to tell you first. You may stop at any time by uninstalling Pocko; email [PLACEHOLDER: contact email for privacy questions and deletion requests] to delete your account or waitlist entry.
2. Pocko is an AI and can be wrong
Pocko's answers, explanations and walkthroughs come from an AI (Google's Gemini). An AI can be wrong: it can misread your screen, point at the wrong thing, give outdated or made-up information, or sound sure when it isn't.
- Check anything that matters before you rely on it, especially about money, health, legal matters, your job, or security. Pocko is not a doctor, lawyer, financial adviser or counsellor.
- Pocko is a friendly character, not a person. He can't promise anything on our behalf.
3. You stay in charge of your PC
- Pocko only points, draws and explains unless you turn on "use my computer" (off by default). With it on, he can click and type in your apps for tasks you ask for.
- Risky steps (sending, paying, deleting) ask for your yes first, he refuses password fields, and he stops the moment you move the mouse or type. Even so, you are responsible for what is done on your PC: watch what he does, and don't let him act where a mistake would be costly.
- Keep your own backups. We aren't responsible for lost files, sent messages or other results of actions you asked for or allowed.
4. Acceptable use
Use Pocko lawfully and fairly. Don't:
- use him to break the law, or to harm, harass, deceive, stalk or spy on anyone;
- show him other people's private information, or screens you aren't allowed to share (for example your employer's confidential data), without the right to do so;
- use him to create sexual content involving minors, other illegal content, content that promotes hate or violence, malware, spam or scams;
- try to get around the sign-in, the invite list, the daily minutes or other limits, or share your access;
- reverse engineer, overload, attack or scrape Pocko Cloud or this website, try to extract Pocko's instructions, or use Pocko Cloud as a general AI service for other apps;
- fill the waitlist with other people's emails, or with bulk or automated sign-ups;
- use him for decisions that could seriously affect someone's life, health or rights without a human checking.
Google's Generative AI Prohibited Use Policy also applies to what you ask the AI. We may suspend access that breaks these rules.
5. Fair use of the daily minutes
Each tester has a daily number of chat minutes, because the AI costs money per minute. When they're used up, Pocko says so and you can chat again the next day. We may change the limit during the beta.
6. What's yours and what's ours
- Yours: what you say and show Pocko, and what he keeps about you. You give us only the rights needed to run Pocko for you, as the privacy notice describes.
- Ours: Pocko, his character, name, look and voice, the app, Pocko Cloud, this website and their content. We give you a personal, non-transferable right to use the beta while these terms apply.
- Feedback: if you send ideas or feedback, we may use them freely, without owing you anything.
- Pocko includes open-source software under its own licences (listed in the app's third-party notices).
7. No warranty
The beta is provided "as is" and "as available", without warranties of any kind, as far as the law allows. We don't promise it will be accurate, uninterrupted, secure or free of errors, or that it will suit your purpose.
8. Limits on our liability
As far as the law allows, we are not liable for indirect or consequential loss (such as lost data, profits or opportunities), or for loss caused by relying on an AI answer or by actions on your PC that you asked for or allowed. Because the beta is free, our total liability for anything else is limited to the amount you paid us for it, which is zero, unless the law requires more. Nothing here limits liability that can't be limited by law.
9. Changes to these terms
We may update these terms as Pocko changes. We'll tell you before important changes apply (in the app, or by email if you're on the waitlist); if you keep using Pocko after that, the new terms apply.
10. Law and disputes
These terms are governed by the laws of [PLACEHOLDER: country], and its courts decide disputes, unless the law of where you live gives you the right to go to your own courts. Please email us first; most problems are quicker to fix that way.
